QUESTION

Can a cop have his children ask me questions during a pullover?

Asked on Jan 30th, 2016 on Criminal Law - Indiana
More details to this question:
I was pulled over this weekend with suspicion that I had stolen a chair from the school and the cop pulled me over not having took it and I consented to a search. The cop's son was outside during the pullover and he was talking to me so my question is can I use that against them by saying I was uncomfortable with telling the truth and lied about what happened. I would also like to know the highest possibility of punishment.

Not sure I understand the question. Do you really mean that you think the officer directed his child to question you instead of doing it himself? Or do you mean that the child just happened to be there during your conversation? Did he find the chair? If you weren't involved with a theft, there is no possibility of punishment. My questions highlight why you should talk to an attorney in your community and give the lawyer all the facts to get your question answered.
