Can a county judge sign a search warrant outside of his county?
Asked on Feb 01st, 2013 on Criminal Law - North Carolina
More details to this question:
The defendant in the case lives in county A. The search warrant was signed and issued from a judge that was elected in county B but in the search warrant there is no mention of County B and claims only that a judge came from County A executed the search and seizure warrant even though the defendant has certified evidence that the judge works under County B and has never worked at County A even though the warrant claims the judge is from County A when the evidence proves the judge never resided in the county at all. Is it judicial fraud to have another county judge claim that he works in the county that the search warrant is executed in? Is it also a invalid search warrant when there are plenty of judges that should have executed the search warrant in the county that the crime was claimed to be committed yet the search warrant was signed by a judge outside of the county that has no connections at all in the criminal case to which the search warrant proceeds?
