Can a dismissed DWI offense with prejudice be refiled?

More details to this question:
An aggravated DWI (3rd offense) is dismissed with prejudice, and is to be refiled as a felony. I thought dismissed with prejudice mean the case cannot be refiled?

If it with prejudice then it should not be refilled.
