Can a driver get a summons issued against another driver for careless driving?

More details to this question:
I rear-ended another car stopped a a light in Brick, NJ The cop who responded dod NOT issue a summons to either driver. 3 weeks later, I received a summons based on the statements of the other driver and his passenger. Is this usual? What are my rights? Any advice? Thank you

The key is whether the police issued the Summons or or this is a 'private' Summons based upon the complaint of the citizens. The latter is far easier to win. Please call if you need help. Ed Dimon
