A week ago I pulled over to the shoulder with my car in park and my hazards on. My friend and I had just gotten Taco Bell and I was feeling sort of nauseous, so I wanted to eat real quick so I would feel better. The next thing I know I have a spot light in my eye. The officer asked me if I was okay and I said yes. He must have smelt the alcohol and told me to get out of the car. I did the walking test and the eye test, (I have Rheumatoid Arthritis so I already have no balance as it is). He said I was under arrest for a DUI and took me to station. I was then having a Panic/Asthma attack, so I needed my inhaler. Finally, let me have my inhaler and gave me breathalyzer around 20 minutes later. I blew a .17 on the BAC... which there is no way it should have been that high because I had 5 drinks, stopped at 1230am, was pulled over around 2:15 AM and he tested me around 3:30am. By that time I should have been the most .06. My question to you is how good of a chance do I have in getting the charges dropped?
