QUESTION

Can a DUI charge be transferred to another state?

Asked on Jan 24th, 2015 on DUI/DWI - Florida
More details to this question:
After my son died suddenly, my husband of one year moved my son and I to FL. We adopted a child after the move. Now, close to five years later he says he doesn't love me anymore and walks out draining the bank account, not paying rent or most of the bills. I recently was arrested and charged with a DUI with property damage. I have no family in this state nor do I work because of disability. I have a home in Kentucky that I had bought before we married. I don't have a choice other than move back there. It is obvious that I can't afford to live in this state. Can or will the Florida courts allow my charges to be transferred to Kentucky? If so what are the steps and how soon can I move?

Unless you are convicted Florida does not care where you live. ( Florida issues DUI citations to tourists all the time). You must be available for court but if you have an attorney some Judges allow the attorney to stand in for you until the actual trial. DUI is a serious charge and you really need an attorney. For a first time offense you probably will not receive a jail sentence but probation would require Kentucky agreement.
