QUESTION

can a judge who signed a search wwarrant hear the same case

More details to this question:
My house was raided and complications arose and my case kept getting switched to different judges now my case is in front of the same judge that signed the search warrant and I was told that I could request to have another judge and they would have to honor my request

it is quite normal that the judge who signed the search warrant is the trial judge. you could make the request that the judge recuse him or herself. however, you would anger the judiciary and would make your case all the more difficult. Please call if we can help. Ed Dimon 732-797-1600
