Can a misdenemor be upgraded to a felony at any time in Illinois.

More details to this question:
My boyfriend has a bad past and was arrested for misdmemor retail theft 8 months ago and let out on a $100 I bond. Last month he missed a court date and a warrant was issued for him they picked him up on it and he is in county right now. Since he already been going to court on this for 8 months can they still raise it to a felony.

Generally speaking, a misdemeanor offense can be raised to a felony offense at any time within 3 years of the incident date.
