Can a person be charged if the home is raided and 10 grams of marijuana is found but no one was home?
Asked on Oct 19th, 2015 on Criminal Law - Michigan
More details to this question:
No one was home when my home was raided by police. Ten grams of marijuana was found. A month after the raid, my wife and I received a notice through the mail to appear for arraignment on marijuana misdemeanor charges. How can they prove possession if no one was home and no proven knowledge or control of the substance can be proven?
Hire a defense attorney and explain the facts to them. It is inferred, through your ownership and occupancy of the home, that you are aware of and control its contents.
