 The key to the answer is dependent upon the reasons that the teacher physically touched child.  For example, a teacher would be permitted to touch a child if the child were fighting with a second child. The teacher would be able to touch a child if child were threatening either another student or threatening the teacher. Key is the intent of the teacher and the circumstances surrounding the touching.  What were the circumstances of the touching ?  Was the child out of control ?  Were their witnesses to what happened ?  What did the witnesses state ?
