can I appeal a failure to blow in breathalyzer case ?

2 years ago my finance was pulled over for possible dwi. He refused to blow. The dwi was thrown out but he was given a,10 years loss of license for failure to blow. In new hampshire he had 2 first offense dwi's from 2 years prior. His attorney in new jersey told him this was not an option and that it would not effect new hampshire. Well recently his plates were run and he found out new hampshire pulled his license. He was not aware this would happen. Can he appeal his sentence?
