Texas. My friend and I were walking at a park and a cop pulled over and accused us of being intoxicated and told us we needed to find a ride back home since we couldn't drive. The cop then left, so I got my friend safely home. On my way home, the cop pulled me over and I was arrested and charged with a Driving While Intoxicated. It had already been about 3 hours since I had my last drink and I didn't think that much to begin with because my profession requires me to have my license. Anyways, I was not read my Miranda rights until after I was in a holding cell. Shouldn't they have been read at the time of my arrest?
You only get Miranda if you are going to be interrogated. And the remedy would be suppress any statement you made. Hire a skilled trial attorney to assess your case.
