Can I avoid jail time for a felony charge?

I recently got my fourth DWI. It was my second in past 5 years with the other two in 87 and 91.

You should call my office for a referral to a lawyer in your area. You are facing a year in jail but a good lawyer may be able to get you a shorter sentence or an in-patient treatment program. You must stop driving or the judge will give you the maximum sentence of up to 4 years.

Probably not. You are looking at between 90 days and 3 years. I strongly suggest that you contact an experienced criminal law attorney for a face-to-face consultation and give him/her all of the facts surrounding your arrest. It is possible because the sentence is up to the judge. However, with that many DUIs it is very likely that you will get at least some jail time.

If you can avoid it depends on all the facts. You would have to go over all them with a lawyer. That person will want to see all the police reports etc.

There are certain statutory minimums for DUI in Georgia, but the typical district attorney is less interested in drunk driving charges than they are violent felonies. I have seen much better deals in felony court for DUI than I have in State Courts (where DUI is about the most serious crime they consider). Contact a DUI attorney in the area of court for best results.

For mandatory minimum sentencing purposes you are facing your 2nd offence. DUI sentencing in PA is governed by prior record score and your BAC. You should consult with and retain an attorney.

If your case is in New Jersey, the mandatory sentence upon conviction for a dui is 180 days in jail, which can be reduced to 90 days, with 90 days of in-patient rehabilitation.
