Can I be charged for "stealing" my own property?

More details to this question:
My ex-wife and I had a storage unit. Her name was on the unit as the owner but I paid for it. When I asked her for the key she refused to give it to me so I broke into the storage unit and took the items from what was remaining that I wanted. She is now telling me that she filed a police report because the items were "stolen". I haven't admitted to her that I've taken the items but there is a bunch of items that she has that I want back. She's telling me the items that I know she took out were stolen as well. My question is, can I tell her that I took the stuff or will that come back to bite me because I took it out of the storage unit without her consent? Does she have any case against me?

the storage unit was rented/leased by your former spouse. you have no rights to this unit. you cannot break into another person's storage unit. you can be charged with a crime. you will inculpating yourself by telling her that you broke into the unit. however, you need to address this situation before you lose control and are facing criminal charges. i would have an attorney negotiate a settlement so that there are no charges. ed dimon, esq. 732-797-1600 ext 235
