I had fellow patron at bar drive me home from unfamiliar location because he said he lived close to me (cannot locate individual now). We were subsequently in accident striking utility pole. He left scene and when police and paramedics arrived, I was outside of car. I had called 911 and said driver had fled scene and I did not think I was hurt. Officer on scene took my license briefly but gave it back and never came to hospital and I have heard nothing for 4 days. Blood was drawn at hospital but nurse told be upon discharge she doubted it could be used against be due to chain of custody issues. Will I most likely be charged?
I would suggest that you immediately engage an attorney, and do not speak with anyone, including and most importantly any of the authorities are please until such time as you have received counsel. The question is not whether or not they can charge you, but rather whether or not they could prove their case.
You can be charged days after or even months after because the statute of limitations hasn't expired yet. They have up to six years from the date of the offense to bring charges against you. It is not uncommon for cases that involve blood draws because they can take anywhere from six months to a year for those lab results to come back from the Michigan State Police. Be proactive and retain an experience DUI attorney now.
