Can I countersue from an auto accident?

More details to this question:
3 cara stopped on the Expressway. I wasn't aware that they all had fully stopped. When I tried to get over again, I hit the last car. The 1st vehicle left and returned. JSO let that person go without adding them to the report. The vehicle that I hit, stated that he saw me coming at a fast speed, but refused to get over or move out of the way

Yes, it looks like you may have a claim against the driver who you feel was negligent. Police reports are not dispositive of civil liability. You should consult with an attorney here in the state of Florida for  contingency fee representation, which means you don't pay anything, unless you win. Also, under the PIP law here in Florida, accident victims must seek medical attention within 14 days of the accident to preserve their personal injury protection benefits in their insurance policy.
