QUESTION

Can I decline to say bad things about my partner when I testify?

Asked on Feb 20th, 2012 on Criminal Law - Colorado
More details to this question:
I've been issued a subpoena to testify. Do I have to appear? If so, can I decline to say bad things about my partner? There are bad cuts on my face and neck and I have a black eye. (I am sure most of which occurred when I pulled a cabinet door off its hinges and smacked myself in the head with it) scratches are from the shoving match that ensued when I falsely accused my girlfriend of stealing money. (I found it of course after she was arrested this morning.) The fight happened because of me and I was just as hateful as her. I really do not want to testify against my spouse. Is there any way I can decline to say bad things about her?

If you have been subpoenad you must appear. It sounds like you may have given false information to the police when they initially contacted you in regards to the fight. If so, you can exercise your constitutional rights not to answer questions at your partner's trial. I suggest you contact an attorney to represent you if this is true.
