QUESTION

Can I expunge details from my criminal record?

Asked on Jan 31st, 2012 on Criminal Law - Texas
More details to this question:
I was arrested in 1993 for auto theft. My court lawyer told me if I plead guilty I would only be charged with a class c misdemeanor, unauthorized use of a motor vehicle. Here 20 years later I find that in 1994 Texas law defined a class c misdemeanor as a state jail felony. The wording felony information shows up on my background search. This reclassification after the fact has limited my ability to secure several job opportunities. Do I have any legal recourse to have this changed or has enough time lapsed to have the case expunged?

Class C is far different than a state jail felony. You need to call a post conviction attorney for a writ of habeas corpus and try and undo it. Yeah that's a huge issue. In Houston I would recommend Josh Shaffer, Troy McKinney or Brian Wice. All are very good, but also very expensive. But what's your life worth to you?
