Your son may have a defense to the DUI/DWI charge. The only apparent evidence against your son is: he was observed driving he admitted to using  pot his lights were off when he was driving at night   An argument could be made that the evidence is insufficient to prove his guilt beyond a reasonable doubt. An investigation should be conducted by a lawyer into all of the facts, including obtaining a copy of the police report. This is a ticket that should be fought.
