QUESTION

Can I get a 36 year old felony expunged?

Asked on Jan 28th, 2013 on Expungements - Louisiana
More details to this question:
I was convicted of operating without owners consent in 1977 (age 18). I was sentenced to 1 year in prison. With time served in county jail while awaiting trial, I served 10 months and was released. I recall my attorney asking the judge to sentence me under the "youthful offender act" so the felony would come off my record after 1 year and not haunt me for life. The judge agreed and did so. For many years, I did not know that it was still showing up on my record. I'm now 53 and disabled and would like to take classes for a concealed carry permit and legally purchase a firearm for home protection but I know that I cannot as long as that felony is still showing up on even the simplest of background searches. Is there any (inexpensive) way to get that felony expunged from my record like it was supposed to be many years ago? Any help is appreciated.

Your felony does not qualify for expungement. You need to contact the court where this occurred and look at the file and try to find out why it was not expunged after 1 year like you thought it would. Or hire an attorney to look into it for you.

Possibly. It depends on the felony but most can be expunged after ten years in Louisiana.
