More details to this question:
I was in an accident. The other person was hospitalized for several days. The police were called. They had me do field tests. Back at the station, my breathalyzer result was 0.09. I admitted to having a few drinks several hours earlier. It was late afternoon. I had a prior DWI plead down to reckless 5 years ago.

I doubt you would be given a non-alcohol offer, especially since there was an accident with injuries. If your first offense was reduced to a reckless, this is technically your first offense.

Most counties will not agree to reduce a OWI charge to a reckless unless there is a good reason. You will have to work it out with the prosecutor.
