QUESTION

Can I get my probation terminated?

Asked on Jun 25th, 2013 on Criminal Law - Texas
More details to this question:
Hello (: I was convicted of a Theft Misdemeanor in Jan. I was put on probation until Feb of 2014. Recently, I violated probation because I absolutely could not get a ride. THEN I missed court, got a warrant, turned myself in and served 3 days in jail. I don't think I can keep up with my probation terms considering the fact that I just got a new job and I am almost 5 months pregnant. Is there any way I can terminate my probation? I already have the conviction, so what's the point? I've seen other people's lawyers get their probation taken away for DUIs so what can I do to get off?

Your attorney can investigate asking for a sentence instead of continuing on probation. The judge has the last say in how long the sentence is. You are exposed to the maximum period set by the sentencing at the plea so be careful, good advice from a competent attorney is advised. You say that you already have the conviction so I must assume that you were not given a deferred sentence. If the court granted a deferred sentence the maximum period of jail is probably one year if the crime was a first degree misdemeanor. There are different rules for deferred sentences and straight probation without deferral. Consult your lawyer to understand the difference and what it means.  Different counties have different rules for how long and where a sentence can be served. Some allow home confinement, three for one credits, work release and etc. See what is available.
