QUESTION

Can I have the DUI removed from my record?

Asked on Dec 15th, 2012 on DUI/DWI - Utah
More details to this question:
I just paid to see my driving record. Surprised to see on there from 1989 (24 years ago) a Prob. DI Deferred Prosecution. Not sure what that means, I know I was NOT convicted of a DUI back then, had a lawyer & that was suppose to give me a break. But WHY is it on my records and is it there on my records "FOREVER"? I totally forgotten about it, lots of my memory is gone since I my two teenage sons died in a car accident so my past if my past & to be forgotten, not reminded of things I regret! Can I have that removed? Thank you.

I do not have sufficient information on which to form an opinion other than it would appear you are finding an arrest record, and not a conviction.

If the record reflects that you were never convicted of the charge then it is accurate. Arrests are public but it is the conviction record that counts.

A DUI cannot be expunged in Michigan. That's why it's important to litigate the DUI until and unless you have no alternatives.

A charge is always on your records, regardless of whether you were convicted, the charges were dismissed, or whether you were acquitted. The only way to get it off is through expungement. There is an eligibility test, if you qualify then you can get it expunged. The waiting period is 10 years. Sounds like that has passed already so you may be good to go right now.
