QUESTION

Can I hit this person legally?

Asked on Nov 21st, 2013 on Criminal Law - Illinois
More details to this question:
I caught my wife cheating, all parties are now aware of each other. The other man has offered to let me hit him if it would make me feel better. If I take him up on this offer, can I be arrested and or sued? My guess is that the worst result to him would be a black eye if I were to hit him, but I'm concerned that perhaps a tooth might be knocked loose or something similar. I'm thinking this falls under "Mutual Combat" but it is unclear if Illinois has such a law.

No, if you hit him, you would leave yourself open to both a battery charge in criminal court, as well as a personal injury case against you in civil court.
