QUESTION

Can I leave the USA while on summary probation?

Asked on Jun 12th, 2014 on Criminal Law - Missouri
More details to this question:
I am on summary probation where I have lived for 27 years. Under the terms of summary probation, I have to attend an 8 hour class by October 12, 2014. I will do that, it is already booked. The summary probation will then solely apply until June 12, 2015. Which if not violated, I will be able to rescind my plea and the case will be dismissed. I wish to visit my daughter in the UK in May 2015. What problems (if any) will I encounter with ICE at either end?

Your best option would be to discuss your options with your probation officer, or the probation department at the court where you received the punishment. This is an instance where it is better to be safe than sorry, and possibly you can work out an arrangement with the probation personnel that will allow you to leave the country.

I would need to know more about your charges and court history to give you a good answer. It would all depend on those two factors.

Since you don't tell me what the underlying charge/conviction is, I cant say. Mt advice would be to speak with the probation office.
