I was arrested for a DUI in a parking structure at 3am. I had gone to the car to take my wallet and phone charger so that I can take an Uber home. While at my car, I heard a loud noise while I was walking away. A police officer came and stated that he saw me driving and that I had collided with a pillar in the parking lot. He stated I scratched/broken my driver’s side mirror. My car has no broken mirror no dent or damage. In his DMV field report, he stated that he arrested me outside my car and in his report to the court, he stated that he and three other officers approached me and arrested me after asking me to park my car after when he observed me driving. I was away from my car walking away to the street where I was to wait for an Uber when he approached me and stated that he had observed me driving my car and caused an accident. Is there any way I can use his two contrasting reports he wrote to the DMV and to the Court as a defense in the case? Although only one officer approached and arrested me, he wrote that another officer investigated and wrote a collision report.
