Can I press assault charges against my neighbor?

More details to this question:
My neighbor charged onto my property and made overt threats of physical violence and death. When I told the neighbor to get off my property he said something to the effect of "I'll leave right after they come pick up your dead body." This altercation ensued after I had gotten into an argument with a friend of the neighbor, That friend then told the neighbor what happened and he returned to my property, coming onto my property and making the threats above. My wife was present outside while this occurred and she was deeply upset by the incident. Both of my sons were in the house at the time and observed it as well. Both were very frightened by what transpired. Do I have a case for assault and can I sue?

You can press charges against your neighbor for harassment and terroristic threats. you can press charges against your neighbor for harassment and terroristic threats   However, to avoid being frustrated by the process, I would make sure that I have sworn statements from all of the witnesses setting for us sufficient criteria to prove both harassment and terroristic threats.  You can utilize our private investigator to interview the witnesses and take sworn statements. If our investigator is of the opinion that you have the proof  of harassment and terroristic threats, then you can decide if you want to hire one of our attorneys as your private prosecutor. I would recommend Valter Must, Esq.  if you do not use a private prosecutor, you'll be frustrated by the system in that the public prosecutor will not pursue these charges with any vigor.  Please call to discuss.
