More details to this question:
I have a pfa on my wife and have temporary custody of our two children. She just found a place so we both decided that she would spend time with them on the weekends. She cannot come within 50 feet of my home so I would have to take them to her. I just found out on Monday that my ATM debit card was misplaced so I called my bank and found out that someone used my debit card on Sunday at an ATM and withdrew $560.00. I asked her about it 3 times and she said she didn't have anything to do with it. It turns out to be her. Can I press charges on her? I have a pfa on her because she tied me up one night and start to cut me. I was thinking of pressing criminal charges then but I started to think that her 7 children may need their mom but because she left them in the house, I now have custody of my biological children. I just wanted to know if I could press charges on her if we are still married.
If she is not on the account and your temporary custody order grants you this account and the funds in the account, you may be able to file criminal charges and file a contempt action in court.
