QUESTION

Can I sue for racial profiling?

Asked on Jan 25th, 2017 on Criminal Law - New Jersey
More details to this question:
I visited a BMW dealership in NJ on 1/25/17. I showed interest in BMW M4. However, the sales rep did not answer any of my questions, did not show me any of the cars, was unfriendly. He went as so far to say he can't help me, that they don't give joy rides here, and told me to come back another day. All the sales people were white. I'm hispanic. I'm also a doctor and have purchased 3 BMW before. I was embarrassed and I was not helped.

You can sue if you can prove the elements of your case, that you were prevented from even taking a test drive for a BMW. I would not say this is criminal law, but it falls under civil rights discrimination statutes. Again, you will have to prove the case, so if you have anything recorded, for instance on your phone, this would be greatly helpful. You could also complain to BMW as they exercise very strict monitoring over their dealerships.
