The judge is in a difficult position with a citizen complaint. This is not a complaint by a police officer. This is not a government action. As such, the judge can decide the merits of the complaint and determine if the case has been proven by the plaintiff. The case may rule for or against the plaintiff. You have the burden to demonstrate that you are the victim of a frivolous lawsuit and are entitled to damages. This can be done and you can get your legal fees reimbursed and punitive damages.
