California Penal Code Section 148.5. (a) Every person who reports to any peace officer listed in Section 830.1 or 830.2, or subdivision (a) of section 830.33, the Attorney General, or a deputy attorney general, or a district attorney, or a deputy district attorney that a felony or misdemeanor has been committed, knowing the report to be false, is guilty of a misdemeanor. A person that is only thirteen violating this section would be handled in juvenile court. It is unlikely the punishment would be more than a stern lecture from the judge.

Yes - but unlikely your child should get punished - that false allegation is too important to allow it to go unpunished - I hope you have done something to bring that home - a person can go to prison for the rest of their life if child does not change mind and make right decision.

Yes. You need to teach your daughter that lying about someone... especially accusing them of sexual assault, is a terrible thing to do. She does a HUGE disservice to those girls/women who are truly victims of sexual assault. Have you ever heard the story "Chicken Little"? Your daughter makes false accusations about someone, eventually people will stop believing her and then what happens in the event that she truly is a victim?

Yes they can. This type of allegation shows a total lack of morals. The child needs direction, discipline and counseling. They could end up in a juvenile facility for this.
