QUESTION

Can my 3rd DUI be a felony?

Asked on Dec 01st, 2015 on DUI/DWI - Michigan
More details to this question:
I am going to court for my 3rd lifetime DUI. The first was in MI in 1993. The second was in GA in 1995. This third is in MI now 2015. GA has lookback of 10 years currently so GA wouldn't use 1995 one against me. Can MI use the GA 1995 DUI to make this a felony? I have been sober for over 15 years and would like to avoid a felony conviction here and go back to my home state soon. Thank you for any advice ahead of time.

Michigan too has a look back provision. Get yourself a good attorney. Even if you escape the felony charge you can expect you past record to impact on the sentencing.

In Michigan this can be charged as a felony. Consult with an attorney in Michigan to discuss your options further.
