QUESTION

Can my boyfriend and I get married with an NCO?

Asked on Apr 05th, 2017 on Criminal Law - Michigan
More details to this question:
My boyfriend and I have been together for almost 3 years, but have been dealing with probation for almost 2 and a half because of weed, nothing more. The last time we were caught with some on us, they gave us a no contact order while we were both on felony probation (5g, which I feel is a little over the top). This no contact order has been an absolute strain because we used to live together and were accomplishing so much together but only 10 months into this it feels like both of our lives are falling apart. We're both struggling where we're living now. He is my absolute best friend and I adore that man just as much as he adores me, and I hate that I can't enjoy going on dates with him or building our lives together all because of a no contact order for being on probation for some weed, that is close to being legalized itself. I know someone's going to say "wait it out" but that is much easier said than done. Put it in this perspective, how would you feel knowing you and your spouse couldn't have any contact for a certain amount of time? It would hurt and cause problems but I'm sure no one would be stupid enough to let themselves break the law like that either. I want to be with this man the rest of my life, but I cannot go another year and 2 months looking over my shoulder when we're just trying to enjoy each other’s company and go on dates like any other normal couple.

I do not see how you could arrange a wedding without having contact with each other. The recommended action is to ask the judge to lift the no contact order. Also, possession of marijuana is a misdemeanor, so they must have gotten you for possession with intent to deliver. That sounds unreasonable to me with only 5g. However, I have no way of knowing right now whether the actual conviction can be overturned.
