Asked on Oct 01st, 2017 on Criminal Law - New Jersey
More details to this question:
my husband is currently serving 180 days for driving suspended he recently submitted a request to see a judge about a fine he has from year 2000 and converting it into jail time and having it run concurrent with his now sentence the judge approved it but my husband just found out last week that instead of the time for the fine running concurrent it is now 29 days tacked onto his 180 days he was never explained this by the judge or anybody else that it wasn't going to be what he submitted for is there a way he can appeal this and have it reversed back to a fine? His job depends on him coming back in time

i did try to answer this question before. the statute sets the sentence at 180 days. There is no discretion. the additional sentence of 29 days can be elimanated by paying the fine. Ed Dimon, Esq. 732-797-1600

Statute set jail time of 180 days for driving on suspended list. no room to negotiate. You can pay the fine and get the 29 additional days removed. This would be the path. Please call if you have issues. Ed Dimon, Esq. 732-797-1600
