Can police question a 13 year old minor without his guardians present?

More details to this question:
The police questioned my 13 year old step son which he was 100 miles away on vacation. He was questioned for a burglary which he was charged with and the degree of a felony. We got the call that he was being arrested and before we could get to him, they questioned him and released him to his grandmother.
