QUESTION

Can requirements for getting your license back after a DUI go void?

Asked on Oct 27th, 2013 on DUI/DWI - Georgia
More details to this question:
My father got a DUI 13 years ago. Part of the requirement was that he go to AA and get a sponsor. He does not have a problem and refuses to go to AA as it would be a waste of his time. Can those requirements go void? Can he just do his other requirements and get his license? We would like to avoid a court case If possible.

Go to the DMV and ask what they want to get the license back.

In Colorado, I would say that it is not likely that this will just go away and there could be a probation violations outstanding. If the court ordered your father to complete a certain amount of AA's or treatment, that was a term and condition of probation with the courts, if it was not finished, there could be a probation violation still outstanding. The DMV will not issue a license until the probation violation case is resolved. It would be wise to contact the DMV and courts to clear up all unresolved matters and obtain a new license.

If his license has been suspended due to a drunk driving charge, then he would have to apply to have it reinstated through the drivers assessment appeal the vision. Among other things, they will need to see documentation of his sobriety for a minimum of one year. While attending AA is not necessarily a requirement, they do like to see participation in some sort of substance abuse counseling or 12 step program. To deny that he has a problem or that he does not need AA, may not go over very well with the hearing officer and he could be denied. If he is denied he can not apply again for it least one year.He needs to make sure he is represented by an attorney with lots of experience in driver's license appeals and restorations. The odds of getting your license back without a lawyer is quite low.

Nope they can't. He should hire a lawyer to go to court to recall the warrant. A lawyer can do this without you present, so it is less risky for him.

In order to get his driver license restored, your dad will have to prove at least one year of total sobriety, as well as verified attendance in a "structured support group. " The only support group I know of that is both well-recognized and free is AA. While it is possible for your dad to get his license restored without documented AA attendance, it will be VERY hard. Your dad should consult with an Attorney who concentrates in driver license restoration law to assist him. If he loses the hearing, he will have to wait an entire year before requesting another one.
