Can the passenger be charged for a crime the driver committed?

More details to this question:
Mom and guy are friends. She was getting a ride to go to a store and then stay the night over the guy’s house. Guy makes a stop prior to going to the store. He explained he had to get something from a friend he then gets back in the car. As soon as he got to the corner, the cops pull him over. He throws the substance into my mom’s lap and states not to throw it back or he will beat her ass. My mom becomes afraid.

Yes. Generally, if more than one person is in a car the law presumes that all occupants are in possession of any drugs and/or weapons found in the automobile.
