Is it legal? Yes. Is it moral? Ill leave that up to you. The bottom line is, your son should find a lawyer. If a lawyer tells the police that (s)he represents your son and he chooses to remain silent, they can't bother him anymore. That doesn't mean they can't arrest him if they have probable cause to do so, but it sounds at this point like their evidence is pretty thin. In the event that they think they do have probable cause . . . well . . . then your son needs a lawyer anyway. Better to get them involved earlier rather than later.
