QUESTION

Can they release you and rearrest you for the same thing?

More details to this question:
My son was arrested for felony possession. It was dismissed and he was on probation. When he went to court for probation, they released him then ten hours later, they came and rearrested him for the same thing. Can they do that?

If he is on probation, then the case was NOT dismissed. The case is still active in some fashion.

Any case that is dismissed without prejudice, as most dismissals are, can be refiled.

There is a disconnect somewhere. If it was dismissed, he wasn't on probation for it. Dismissal means it is over.
