Can you be charged for this?

John took acid on his 17th birthday along with his girlfriend. His girlfriend was founded later wandering on the streets, publicly intoxicated and also under the influence of LSD. She was later caught and her parents ratted John out. EMT's and police officers then arrived to John's house and took him to the hospital under the impression that he was incoherent (when arrived at the hospital, the doctor was confused to why they put him on an ambulance because he was completely responsive). John's had a perfectly clean records, is a good student, and this is his first brush with the law. He was never taken to jail, but an officer did arrive to his house for questioning; John was polite with the officer, but he didn't jot down any notes when John gave his side of the story. It's been 3 weeks and he has not heard anything about a court date. Do you think his consequences will be severe?
