QUESTION

Can you be pulled over for no reason?

Asked on Mar 12th, 2013 on DUI/DWI - Louisiana
More details to this question:
I was pulled over for no reason at all. I wasn't speeding or swerving or anything. I asked cop and he didn't say anything but get out of car. I stumbled on the line he made me walk and he arrested me for DUI. Was this legal? No breath test, no blood test. Nothing. Can I fight this and how much will a DUI lawyer cost me?

It is a constitutional violation to be stopped without probable cause. If you can convince a judge were, the evidence against you is thrown out and you walk. Your story sounds like one I've heard a hundred times. You need a lawyer to have any chance to fight it.

You cannot be pulled over for no reason. The officer must have probable cause to make the traffic stop. If the officer did not have probable cause to stop you any evidence which he obtains subsequent to the illegal stop would be allowed to be used against you in court. An estimate of the cost in such a case would range from $1500 to $2500.
