Can you get charged with OWI if you were trying to get a car out of a ditch?

My friend is being charged with an OWI when it was me who drove the car, spun out on black ice and ended up in the snow in a ditch. We switched places since it was his car to try to get it out of the ditch and that is when the cop came up. They charged him with OWI, didn't even ask me to be tested and now we don't know if this is even possible. I tried to get camera from the place we were at showing I got in the car as the driver but no one has proof. He was not seen on the road just in the ditch.
