QUESTION

Chances of getting conditional discharge downgraded to loitering fee?

Asked on Aug 11th, 2013 on Drug Crimes - New Jersey
More details to this question:
hi i am an nj resident over the age of 18 who, 2 months ago, was arrested for being "under the influence" of marijuana-first offense. I was in a parked vehicle in the back seat, and a police car came up behind us and found marijuana in the hands of the person in the passenger seat. I was arrested, but was not told my miranda rights. I was put into jail for a few hours, and my arrest papers stated that i was under the influence. I hired a lawyer, and went to court for the first time. I was not drug tested or anything. I have to make a second appearance in a few days. I understand everything about conditional discharge, but here's the thing-i will be going away to college in a week and a half on practically a full scholarship, and the school is over 5 hours away. I am unable to have a car on campus, so i cannot possibly commute to new jersey to check in with a PO. Will my conditional discharge-assuming I am granted this-be transferred? I just want it all to go away.

you will not have any problems with the 'conditional discharge' while you are an 'out-of-state' college student. there are no reporting requirements. the key condition is that you not be arrested for another charge during the one year period. please let me know if we can help. ed dimon, esq.
