QUESTION

Class B misdemeanor - Prostitution

Asked on Feb 18th, 2014 on Criminal Law - Texas
More details to this question:
Arrested and bonded out a few days ago in Brazos county in Texas for a prostitution charge (I was from out state visiting). I know there is little chance of jail time for first time offender. I made a mistake of talking too much to the cop although did not expressly admit to having sex with the woman. (1) I do not want to go to trial, (2) How easy to dismiss this charge? (3) I am told no pre-trial diversion in this county so what about deferred adjudication with non-disclosure? (4) how much damage when prospective employers see arrest now while case is being sorted out in the Court system? Can I explain that it was a huge misunderstanding and it is receiving attention in the Court system? (5) Or is my life basically over for good with this? (6) I cannot have a conviction in my record because my state of residence requires sex offender registration which will kill my career. WHAT ARE MY OPTIONS?

I agree with Kenneth, your life is not over.  Take a deep breath and get an attorney who does criminal work in Brazos County.  Make sure you are clear with the lawyer what it is you are trying to accomplish.  But please keep this in persepective.  I know it feels like your life is over--it is not!  Your options depend on the facts of the case, the alleged evidence the State has regarding this matter and whether or not the State can prove beyond a reasonable doubt each and every element of the offense.  Make sure you know the difference between expungement and non-disclosure.  And whether given your particular circumstances you can even consider disposing of your case via plea bargain or via bench or jury trial.  Do not presume now what you will or will not do.  You need legal advice and you need it sooner than later.  I assure you it will take some of the stress off of your life.  Again, your life is not over!  Don't give up...

Your life is not over. You need a really qualified criminal defense attorney in Brazos County to see about deferred or an alternative penalty. Only an attorney who practices in that county can answer your questions.
