QUESTION

Cop gave me a ticket using my fake I.D. can I get charged still?

Asked on Sep 08th, 2012 on Criminal Law - New York
More details to this question:
I was given an open container ticket in a state that I don't live in. I gave them my fake I.D. and they wrote it out using the fake information, the only thing that is legitimate is my name and birth date. Will they find a way to charge me or even take the time to find my real information?

I can guess as well as you. If they can determine your real identity through name and birthdate match, and pictures on the licenses, they will issue a warrant for all the charges you have generated by doing this. You'll know when it happens, by being arrested.

They could, depending on the state. If you have an uncommon name, it will be easier for them to find you.

Yes they can charge you. Yes they have plenty of ways of finding out who you are. They deal with these things all the time.

I would not rely on that. It is possible that they will find you out if you gave name and date of birth. They could find true name particularly if the fake id had your address or state.

it depends what the ticket was for as to how much time they will spend to find you. However, since they have your name and date of birth, they should be able to track you down. It may also be a crime to have used the fake id in the first place.

You could potentially be charged with giving the false information. But it had your correct name and date of birth. So, only the address was not good.

If they do you can be re-cited and also charged with giving false information to law enforcement and possibly identity theft.

HYPOTHETICALLY SPEAKING: The cop didn't spot the fake ID Ha! If they do take the time to track you down it will be in spite, and for felonies. If I was the cop I would contact the people you were with or the people at the place you came from and ask them. Further, if your fake ID was a different person's ID, then that person will likely "give you up." The latter would probably be the bigger concern.

Depends on how aggravated and motivated they are. With a name and correct birth date is is very simple to find a person.

If you don't appear there will be an arrest warrant issued for you. If your real name and date of birth are on the ticket the warrant will turn up anytime you get pulled over or stopped by the police. Just deal with the ticket.
