If you can show the inability to pay for a private attorney, the judge can appoint the Public Defender's Office to represent you.

You could if the Judge deems you indigent, but even then the PD will not be allowed to represent you at the DMV, which is equally important. You should spend some money and hire a DUI specialist, and do it soon because you have only 10 days to save your license at the DMV.

In Wisconsin, there is no jail time attached to a first offence OWI, so it is unlikely you could get a public defender. But it is a good idea to retain an experienced OWI lawyer. It's almost always worth the investment.

If you cannot afford a lawyer, a lawyer will be provided for you and then charged against you as you are able to pay in the future. Is your first appearance before the court and you should inform them you cannot afford counsel and they will give you a form to fill out and determine whether or not, in their estimation, that is true.

Getting a Public Defender is based upon one's income level. Court clerk can provide you the form to apply.
