Asked on Jan 27th, 2015 on Criminal Law - New Jersey
More details to this question:
I have criminal charges against me from three bogus temporary restraining orders which were all dismissed.there was no assaults or threats and was proven in court that my ex wife was untruthful. She filed them for the sole purpose to get me in legal trouble and to gain custody of our twelve yr old son.the police lied and said they smelled fresh marijuana from outside a detached garage more than a hundred feet from my house.they found pot but it was in four bags hidden in a kayak, there was no way they smelled anything, they were going on info from my ex wife.they are trying to say I grew it.there were no plants and never were.anyway what motions could be filed to get evidence suppressed?it was 5 ounces and I was indicted.

We can represent you on the motion to suppress. We can represent you with regard to the criminal charges. I was the first assistant prosecutor in Ocean County. I have a partner who has been a prosecutor for 30 years. The key to success on the motion to suppress is demonstrating that the police had no reasonable basis for coming on your property and searching. We would have to determine if your spouse gave them permission to come on the premises or if she gave them circumstances which would support that a crime was being committed. The devil is in the details. Please call to discuss.
