QUESTION

Do 3 violations stay on my record?

Asked on Nov 07th, 2012 on Drug Crimes - New York
More details to this question:
I was charged with unlawful possession of marijuana and trespassing at my boyfriend's college, which is a SUNY college, so the police officers are technically state troopers. 3 weeks later I was charged by the same exact cops for unlawful possession of alcohol under the age of 21. This happened two days before my UPM trial. Are these going to stay on my record? I am terribly worried because my boyfriend is leaving that terrible school to join the military and neither of us need a criminal record.

It sounds like the 3 violations you mentioned are not crimes. Possession of alcohol under 21 is usually a city code violation and not a crime. Unlawful Possession of marijuana is a violation and not a crime, and Unlawful Trespass is also a violation and not a crime. You could ask for a public defender but because they are not crimes, the judge might not assign one. The record should be sealed in 3 years or less but if you apply for a gun permit or to be a police officer, you will have to say that you were arrested for these things and you can explain them.
