Do I have a case?

More details to this question:
My cell phone (iPhone 4) was stolen which atfirst seemed liked no big deal. I paid the 170.00 for a replacement. But then a couple of weeks later a facebook page appeared which turned out to be a complete mirror or my own facebook. Who ever stole my phone created this fake page of me. They requested my parents, my siblings, my friends, co-workers, acquaintances, then they started posting pictures of my sister's birthday party which was all just really odd to me at first. I thought it was a friend just messing around with me -- until finally I guess this person who stole my phone started posting my "private" photos on the page. The indecent photos were in a locked album in my phone and were only in there because at the time i was in a long distance relationship - which (i know) is irrelevant but i know i'll get the few comments "Well why were there pictures like that in your phone" I already know they shouldnt have been there, but the damage has been done. Do I have a case here?

you can bring a civil action against the person who stole your phone and who is posting the pictures.  a criminal action will be difficult because you will have to convince the police and prosecutor to get involved. very difficult without direct proof.  a civil action will be expensive because you will have to prove your case and you will need an attorney to prosecute and an investigator to investigate. please let us know if we can help. ed dimon, esq.
