. I was at the lake that day and stopped drinking around 5:30. I had a total of 4 beers that day and was acting very responsible. My boat ingested water in the engine so I spent some time from 6-9:30PM working on my boat and getting the water out. Left my unit and got on the highway . I was sending out an email while driving and did not use blinkers when changing lanes. A cop pulls me over and I drive a few exits and pull in a gas station. Refused to pull over on the side of the highway for my safety. Cop asks me if I had been drinking and told him the truth. He got me out of the car and got me to perform FSTs. He did a total of about 5-6 tests. I felt I did well on the walk and turn one leg stand. He said I passed the one leg stand and failed the HGN & walk and turn. I counted to 10 instead of 9 to prove to him that I was fine. He made me take the walk and turn in sandals too and I felt he never explained the instructions well enough. He arrested me based on the tests and refused the breathalyzer because I don't trust the reader. Brings me to jail and then no testing done in jail even though I requested it. Now I am headed to trial and will have the cop testifying and the video. What are my chances of beating this? They also searched my truck and found nothing. I was only headed home and had stopped drinking like 4 hours before the incident.
No lawyer can tell you your chances just based on your story. You need the video, the ALR hearing and any other evidence they have. But you absolutely need a DWI attorney.
